1.1 Provider
StromNow UG (haftungsbeschränkt), Blankenfelder Dorfstraße 34, 15827 Blankenfelde-Mahlow, Germany (hereinafter referred to as “StromNow”, “we”, “us” or “Provider”), operates the StromNow Fleet Portal and Fleet Dashboard (hereinafter referred to as “Fleet Portal”, “Web Portal” or “Dashboard”).
The Fleet Portal is intended for business customers, companies, self-employed persons, freelancers, fleet operators and other commercial users (hereinafter referred to as “Customer”, “Business Customer” or “Company”). Consumers within the meaning of Section 13 of the German Civil Code (BGB) are not the target group of the Fleet Portal.
1.2 Scope
These General Terms and Conditions apply to the use of the Fleet Portal, the related services, the management of drivers, vehicles, charging cards, charging processes, payment and billing processes, as well as to all contracts concluded between StromNow and the Business Customer in connection with the Fleet Portal.
Deviating, conflicting or supplementary general terms and conditions of the Customer shall not become part of the contract unless StromNow expressly agrees to their validity in text form.
1.3 User Groups
In the context of the Fleet Portal, the following user groups may in particular exist:
1.4 Contractual Relationship
The contractual partner of StromNow is generally the Business Customer. Drivers, administrators or other users act within the scope of the use of the Fleet Portal under the responsibility of the Business Customer, unless they expressly conclude a separate contract with StromNow.
The Business Customer is responsible for all actions carried out via its accounts, administrators, drivers, charging cards, RFID tokens or other authentication methods, unless such actions are based on circumstances attributable to StromNow.
2.1 General Service
StromNow provides the Business Customer with a web-based Fleet Portal through which business charging processes, drivers, vehicles, charging cards, charging histories, invoices, payment and billing data, statistics and other functions related to electric mobility can be managed.
